Terms of Service

1. Acceptance of Terms
By accessing and using our equipment rental, maintenance, and project management services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use our services.
2. Equipment Rental Services
2.1 Rental Agreement
All equipment rentals are subject to availability and confirmation. A signed rental agreement and valid payment method are required before equipment delivery. Rental periods begin when equipment leaves our facility and end when it is returned to our designated location.
2.2 Equipment Condition
Equipment is provided in good working condition. You are responsible for inspecting equipment upon delivery and reporting any issues within 24 hours. You agree to return equipment in the same condition, normal wear and tear excepted.
2.3 Authorized Use
Equipment may only be operated by trained and authorized personnel. You agree to use equipment only for its intended purpose and in accordance with manufacturer specifications and safety guidelines. Modifications to equipment are strictly prohibited.
3. Payment Terms
3.1 Rental Fees
Rental rates are based on daily, weekly, or monthly periods as specified in your rental agreement. Late returns will incur additional charges. All fees are due upon invoice date unless other arrangements have been made in writing.
3.2 Deposits and Security
A security deposit may be required for equipment rentals. Deposits will be refunded upon satisfactory return of equipment, minus any deductions for damages, cleaning, or outstanding fees.
3.3 Payment Methods
We accept bank transfers, credit cards, and approved purchase orders. Late payments may incur interest charges and result in suspension of services.
4. Liability and Insurance
4.1 Client Responsibility
You are responsible for loss, theft, or damage to rented equipment from the time it leaves our facility until it is returned. You agree to maintain appropriate insurance coverage for the full replacement value of the equipment.
4.2 Third-Party Claims
You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of our equipment, including but not limited to property damage, personal injury, or death.
4.3 Limitation of Liability
Our liability is limited to the repair or replacement of defective equipment. We are not liable for indirect, consequential, or incidental damages including lost profits, project delays, or business interruption.
5. Maintenance Services
5.1 Service Scope
Maintenance services include preventative maintenance, repairs, and emergency response as specified in your service agreement. Service schedules are subject to technician availability and may be adjusted with reasonable notice.
5.2 Access and Conditions
You agree to provide safe access to equipment and work areas. We reserve the right to suspend work if conditions are deemed unsafe or if access is restricted.
5.3 Parts and Materials
Unless otherwise specified, we use genuine OEM parts or approved alternatives. Parts warranty is limited to manufacturer specifications. Labor warranty is 30 days from service completion.
6. Cancellations and Returns
6.1 Rental Cancellations
Cancellations must be made at least 48 hours before scheduled delivery. Late cancellations may incur fees up to 50% of the first rental period.
6.2 Early Returns
Equipment returned before the end of the rental period is subject to the minimum rental period charges. No refunds or credits are provided for early returns unless previously arranged.
7. Safety and Compliance
7.1 Safety Requirements
You are responsible for ensuring all operators are properly trained, certified, and equipped with appropriate personal protective equipment (PPE). You must comply with all applicable safety regulations and standards.
7.2 Incident Reporting
Any accidents, injuries, or equipment malfunctions must be reported to us immediately. You agree to cooperate with any safety investigations or incident reviews.
8. Intellectual Property
All content on our website, including text, graphics, logos, and images, is our property or our licensors' property and is protected by copyright and trademark laws. Unauthorized use is prohibited.
9. Termination
We reserve the right to terminate or suspend services immediately if you breach these terms, fail to make payments, use equipment improperly, or create safety risks. Termination does not relieve you of outstanding payment obligations.
10. Governing Law
These terms are governed by the laws of the jurisdiction in which our primary business operates. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
11. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
